For any questions or inquiries that are sent via email or contact form, the user consents to the recognition of this information by establishing the first contact. This requires the specification of a valid email address and serves for the assignment of the request and the subsequent answering of the same. The specification of further data is optional. The information you provide will be stored for the purpose of processing the request and for possible follow-up questions.

    4. ‘processor’ means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller;
    5. ‘third party’ means a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data;
    6. ‘consent’ of the data subject means any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her;

You have the right,

  1. to request information on categories of processed data, processing purposes, any recipients of the data, the planned storage duration (Art. 15 GDPR),
  2. to request the correction or addition of incorrect or incomplete data (Art. 16 GDPR);
  3. to withdraw a given consent at any time (Art. 7 (3) GDPR);
  4. to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you, including profiling based on those provisions. (Art. 21 p.3 GDPR);
  5. to demand the deletion of data in certain cases pertaining to Art. 17 GDPR – especially if the data for the intended purpose is no longer required or processed unlawfully, or you consent to the above (c) revoke or disagree according to the above (d) explained;
  6. under certain circumstance, to request the restriction of data in the event where a deletion is not possible, for example when the deletion obligation is debatable (Art. 18 GDPR);
  7. in regards to data portability, i.e. you may receive your data provided to us in a common machine-readable format, such as CSV/resume and have the right to transfer it to others (Art. 20 GDPR);
  8. to file a complaint by the responsible authority over data processing (for telecommunications contracts: the Federal Commissioner for data protection and the freedom of information; furthermore: State Commissioner for data protection and the freedom of information NordrheinWestfalen)

To data processors, which are companies with which we are legally required by law to use to process data, Art. 28 GDPR (Service Providers, Agents). In this case, BENOCS GmbH remains responsible for the protection of your data. We engage companies in the following areas: Cooperation partners, who provide services, for example in relation to your service contract with BENOCS GmbH. In this case, if you entrust services of such partners to us or if you consent to the involvement of the partner or if we involve the partner on the basis of a legal license.

In certain cases, we are required by law to provide certain data to requesting government agency.

Your data is processed in Germany and in other European countries. If, in exceptional cases, your data is also processed in countries outside the European Union (in so-called third countries), this will take place,

  1. insofar as you have expressly consented to this (Art. 49 para. 1a GDPR).  (In most countries outside the EU, the level of data privacy does not meet EU standards. This applies in particular to comprehensive monitoring and control rights of state authorities, e.g. in the USA, which disproportionately interfere with the data privacy of European citizens,
  2. or insofar as it is necessary for our provision of services to you
    (Art. 49 para. 1b GDPR),
  3. or insofar as it is provided for by law (Art. 6 para. 1c GDPR).

In addition, your data will only be processed in third countries if certain measures ensure that an adequate level of data privacy exists (e.g. adequacy decision of the EU Commission or so-called suitable guarantees, Art. 44ff GDPR).

  1. Technical Features: When you visit our web pages, the web server records the domain name or IP address of your computer, the file request of the client (file name and URL), the HTTP response code, and the web page from which you are visiting us. The logged data are used exclusively for data security purposes, in particular for the defense against attempted attacks on our web server (Art. 6 para. 1 f GDPR). This data is neither used for the creation of individual user profiles nor passed on to third parties and will be deleted after 7 days at the latest. We retain the statistical evaluation of anonymized data sets.
  2. Other: Additional personal data, such as your name, address, telephone number or e-mail address will not be recorded unless you provide this information voluntarily. In order to improve better communicate to you, your information may be processed in third party content management systems.

Some of the offer pages contain buttons from social media networks (LinkedIN, Twitter button), with which you can recommend BENOCS GmbH to your friends and acquaintances.

The control over using these sites lies completely with the user. By using the buttons you establish the direct contact between the respective social network and the visitor only if you actively click on the button (one-click solution).

By activating the Social Media Plug-in (Art. 6 p. 1 a GDPR), the following data can be transmitted to the social media providers: IP address, browser information, operating system, screen resolution, installed browser plug-ins such. For example, Adobe Flash Player, previous web page, if you followed a link (referrer), the URL of the current webpage, etc. When the web page is refreshed, the social media plug-ins will be redeployed to the default inactive mode, therefore when you revisit the website, no data is transmitted.

We want you to use our website as well as our products and services. In order to find the products that interest you and to make our websites user-friendly, we analyze all usage behavior anonymously or pseudonymously. Within the framework of legal regulations, we, or companies commissioned by us in the context of order data processing, create usage profiles. Therefore, a direct file is not possible. Below you can find general information about the different purposes and techniques that we use. You are allowed to refuse, however, please note that in this case you may not be able to use all functions of our website.

  1. Tag Management: Tag management is used to manage tracking tools in web pages. For this purpose, a mark is set for each page that can be used to determine which tracking tools to use for this page. The tag management can thus be used to control the tracking, so that the tools are only used where they make sense.
